Terms of Use

1. Purpose & acceptance

These terms govern access to subkickcaption.com and use of the Subkick Caption plugin (the “Software”), in all its versions, present and future — trial, free or paid — as well as its updates. By accessing the site or using the Software, you accept these terms. The Software is currently offered as a trial (beta).

2. Beta access

Access is reserved for people holding an access code and/or a license key, which are personal to you. You agree not to share them. Any sharing or circumvention attempt may lead to immediate revocation of access.

3. Plugin license

Subject to compliance with these terms, you are granted a personal, non-exclusive, non-transferable license limited to a single computer. The license key binds the plugin to the first machine that activates it.

You are strictly prohibited from:

  • copying, redistributing, reselling, lending or making the plugin or key available to third parties;
  • decompiling, disassembling or reverse-engineering;
  • circumventing, disabling or altering the license or protection mechanisms;
  • removing ownership notices, markings or license identifiers.

Each output generated by the plugin may carry a marking allowing the originating license to be identified in case of unauthorised distribution.

4. Intellectual property

The plugin, the website and all their elements remain the exclusive property of Robin Carayol. This license transfers no ownership rights to you.

5. Availability & warranties

During the trial (beta) phase and for free versions, the Software is provided “as is”, without any warranty of availability, freedom from error or fitness for a particular purpose; changes, interruptions or resets may occur, and it is your responsibility to back up your projects. Paid versions intended for consumers remain subject to applicable statutory warranties.

6. Liability

To the extent permitted by law, the publisher's liability cannot be engaged for any indirect damage resulting from the use or inability to use the plugin.

7. Termination

The publisher may suspend or revoke access and the license in the event of a breach of these terms, in particular key sharing, infringement or circumvention of protections.

8. Governing law

These terms are governed by French law. In the event of a dispute, and failing an amicable resolution, the French courts shall have jurisdiction.

9. Future versions & changes

These terms apply to the Software in all its versions, present and future, as well as its updates. They may be updated; the applicable version is the one in force at the time of your use, and any continued use after a new version is published constitutes acceptance.
