End-User License Agreement

This agreement (the “License”) is entered into between Robin Carayol, sole trader (the “Publisher”), and anyone using the Subkick Caption plugin (the “Software”, “you”), in all its versions, present and future — trial, free or paid — as well as its updates. By installing, activating or using the Software, you accept this License. If you reject it, do not use the Software.

1. Grant of license

The Publisher grants you a personal, non-exclusive, non-transferable, revocable license limited to a single computer. The license key binds the Software to the first machine that activates it. This License governs your use of the Software in all its versions and updates, present and future. The Software is currently provided as a trial (beta).

2. Restrictions

You shall not:

  • copy, reproduce, distribute, resell, rent, lend or share the Software or the license key;
  • decompile, disassemble or perform any form of reverse engineering;
  • circumvent, disable or alter the license, activation or protection mechanisms;
  • remove or hide ownership notices, markings, watermarks or license identifiers;
  • use the Software to develop a competing product based on how it works.

3. Intellectual property

The Software, its code, its resources and the “Subkick Caption” trademark remain the exclusive property of the Publisher. This License grants you no ownership rights, only a limited right of use.

4. Activation, verification & traceability

The Software verifies license validity online, including at start-up, and binds the license to your machine. Outputs produced by the Software may carry a marking allowing the originating license to be identified in case of unauthorised distribution. The processing of related data is described in the Privacy Policy.

5. Availability & warranties

During the trial (beta) phase and for free versions, the Software is provided “as is”, without any warranty of availability, freedom from error or fitness for a particular purpose; changes, interruptions, resets or revocations may occur, and it is your responsibility to back up your projects. Paid versions intended for consumers remain subject to applicable statutory warranties.

6. Limitation of liability

To the extent permitted by law, the Publisher's liability cannot be engaged for any indirect damage, loss of data or loss of projects resulting from the use or inability to use the Software.

7. Term & termination

This License applies for as long as you use the Software. The Publisher may suspend or revoke it immediately in the event of a breach, in particular key sharing, copying, infringement or circumvention of protections. Upon termination, you must stop all use and uninstall the Software.

8. Governing law

This License is governed by French law. Failing an amicable resolution, the French courts shall have jurisdiction.

9. Future versions, changes & contact

This License applies to the Software in all its versions and updates, present and future. It may evolve; the applicable version is the one in force at the time of your use, and any continued use after a new version is published constitutes acceptance. Paid versions may be subject to additional terms of sale.
